As an employment-based visa, individuals looking to relocate to the United States with an EB-3 visa must meet the work requirements of one of three different classes. Specifically, applicants can qualify for an EB-3 visa as a “skilled worker,” a “professional,” or as an “unskilled worker.” However, many workers experience understandable confusion when examining the requirements of the EB-3 visa and determining whether or not they are eligible for this visa option.
At AmLaw Group, we know how important it can be for your family and your career for you to relocate to the United States, and that is why we are committed to helping you evaluate all of your visa options and apply for the visa that is right for you, your family, and your future.
Eligibility Requirements for an EB-3 Visa
There are different eligibility requirements for foreign nationals who are applying for an EB-3 visa as a skilled worker, a professional, or an unskilled worker. These requirements are as follows:
- Skilled Workers: To qualify for an EB-3 visa as a skilled worker, individuals must be able to demonstrate that they have at least 2 years of relevant job training and/or job experience. They must also be able to show that they are filling a position for which there are not qualified workers available in the U.S.
- Professionals: To qualify for an EB-3 visa as a professional, those applying must be able to demonstrate that they hold a U.S. baccalaureate or the international equivalent to this degree, and that this degree is required of those who are applying for the job in question. They must also be able to show that they are filling a position for which there are not qualified workers available in the U.S.
- Unskilled / Other Workers: To qualify for an EB-3 visa as an unskilled worker, those applying must be able to prove that they are able to provide labor requiring less than 2 years of training/experience for which there are not qualified workers available in the U.S.
Proving that you meet any of the above qualifications can seem like a complicated task, but at AmLaw Group, we are ready to make this process as simple and fast as possible.
